Lovely, large, very clean, recently updated three bedroom, 2 bath home in South Wales, New York, directly across the street from Notting Hill Farm wedding venue! Very private! Sleeps 6! Forget your worries and enjoy the serene and peaceful setting. A/C, full kitchen, 2 seating areas, brand new deck with gas fire pit. Close to wedding venues, Kissing Bridge, Darien Lake theme park, the village of East Aurora, 20 min. to Highmark Stadium, 30 min. to Buffalo Airport, 25 min. to downtown Buffalo. Check-in time is 3:00pm or later; check-out time is before 11:00am.

House Rules

TERMS

• NO PARTIES or SMOKING!! Guest agrees to pay a $500 FINE plus damages for any event or party. THIS INCLUDES SMOKING. EVEN IF THE PROPERTY IS RETURNED TO PERFECT CONDITION. Guest agrees not to have any party, event, or gathering of ANY KIND involving any guests outside of those listed on the reservation. Music and talking volume are to remain at respectful levels during day and night time hours.

• Ownership: The Rental Unit is privately owned by an independent third-party (the “Owners”) for which The Host is acting as agent.

• Rental Party: The rental party shall consist of Guest and the persons listed on his reservation (the “Rental Party”). Guest must be 21 years of age or older to rent the unit. Members of the Rental Party are the sole responsibility of the Guest. The property is not child-proof and is not recommended for small children. The road where the home is located is on a 45mph road, surrounded by woods, and there is a large pond in the backyard. Therefore, members of the Rental Party under 12 years of age must be accompanied at all times.

• Maximum Occupancy shall equal to the stated number of beds in each listing. Visitors: Only members of the Rental Party are permitted to stay in the Rental Unit. Anyone else the Guest allows in the Rental Unit (a “Visitor”) is the sole responsibility of the Guest and is strictly forbidden unless approved by The Host.

• Term of the Agreement: The rental period begins at 3:00 PM EST on the “Check-in Date” and ends at 11:00 AM EST on the “Checkout Date” (collectively, the “Rental Period”).

• Late Checkout Fee: Unless permission is specifically granted by The Host, Guests who fail to checkout by the Checkout Time will be charged at a rate of $100 per hour beyond the Checkout Time.

• Minimum Stay: This Rental Unit requires a certain number of nights minimum stay. Longer minimum stays may be required during holiday periods or if otherwise specified by The Host.

• Rental Rules: At all times throughout the Rental Period, the Guest shall and shall cause the Rental Party and any Visitors to abide by the rental rules.

• Access: Guest shall allow The Host access to the Rental Unit for purposes of repair and inspection. The Host shall exercise this right of access in a reasonable manner.

• Damage: Guest shall report any damage or issues with the Rental Unit to The Host upon arrival or occurrence. Guest shall be responsible for any damage to or loss from the Rental Unit which occurs during the Rental Period, howsoever caused.

• Rental Rate and Fees: Payment in full of the posted fees shall be due upon booking.

• Security Deposit: At the discretion of The Host, a security deposit may be required on the Check-In Date. Where applicable, such deposit is for security purposes and shall be refunded within 7 days of the Check-out Date provided no deductions are made due to: damage to the Rental Unit or contents thereof; debris or other mess requiring excessive cleaning; or any other cost incurred by the host as a result of the Guest’s stay.

• Cancellation Policy: The cancellation policy through the booking channel is what would be honored in the case of cancellation. For direct bookings or non-channel bookings, the cancellation policy is as follows: 100% if cancelled 30 days prior to the Check-in Date or within 48 hours of your booking confirmation. 50% if cancelled 14 days prior to the Check-in Date. No refund shall be given for any cancellations that happen within 14 days of the check-in date.

• Use of Certain Areas: Unless permission is specifically granted by The Host, Use of the Rental Unit DOES NOT include the use of the basement or garage. Any and all references to the Rental Unit throughout this Agreement does not include the basement or garage unless otherwise specified by The Host.


• Use and Maintenance of the Rental Unit. The Guest agrees to use the Rental Unit only for the purpose for which it is rented herein and in accordance with this Agreement. The Guest further covenants and agrees to maintain the Rental Unit in a clean, orderly, safe, and sanitary condition, free of trash, junk, bodily fluids, refuse, nuisances, or conditions that threaten or tend to threaten the health or safety of anyone, and in a manner or condition which is aesthetically pleasing. The Guest shall not permit any use of the Rental Unit which is inconsistent with or contrary to this Agreement, or which is contrary to applicable laws, rules, and/or regulations (“Applicable Laws”). No business may be conducted from the Rental Unit.

• Security: Property has a nest camera doorbell and security cameras on the perimeter of the building (facing out).

• Insurance: The Guest expressly recognizes that any insurance for property damage or loss which may be maintained on the Rental Unit does not cover the personal property of the Guest, and that the Guest is responsible for purchasing their own insurance for if such coverage is desired.

• Indemnification and Assumption of Risk: Under no circumstances shall the Host, the Owners, their heirs, officers, agents, and employees be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, caused or incurred whether arising in contract, or otherwise in law or equity as a result of rendering of the services or accommodations as described in this Agreement or as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the services or accommodations. Additionally, the Host, the Owners, their heirs, officers, agents, and employees shall not be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise caused by reason of military actions, acts of God, fires, floods or other casualties, weather conditions, power failures, pandemics, strikes, riots, embargos, delays in transportation, activities conducted on other properties, inability to obtain supplies or requirements, or regulations of the United States government or any other civil authority. Notwithstanding the foregoing, if the Host determines, in its sole discretion, that the property, through no fault of the Guest, is unavailable due to circumstances including, but not limited to, destruction or severe damage due to weather or sale of the property, the Host will refund all the monies paid. This will be the full extent of the Host’s liability to the Guest in such circumstances, and the Host, nor the Owners, will not be responsible for any other costs connected with any such cancellation, howsoever arising. The Host reserves the right to change the Rental Unit fees and policies at any time for any reason.

Guest hereby waives and releases, indemnifies, holds harmless and forever discharges the Host, the Owners, their agents, employees, officers, directors, affiliates, successors, and assigns (collectively, its “Agents”), of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that Guests, the Rental Party, or their invitees, visitors, or any other persons injured as a result of Guest’s tenancy or actions, ever had or may have, arising from or in any way related to participation in any of events or activities conducted on the premises of the Rental Unit, and acknowledges that this waiver of indemnification and liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct by the Host, the Owners, or their agents. Guest, on behalf of itself and its heirs, assigns, and next of kin, waives all claims for damages, injuries and death sustained to itself or its property, that Guest may have against the aforementioned released party to such activity. By this Waiver, Guest assumes any risk, and takes full responsibility and waives any claims of personal injury, death, or damage to personal property. Guest further understands that the Host nor the Owners make no claims or representations about fitness for use of the land for any particular purpose and that it is using said property at its own risk.

• Governing Law. This Agreement shall be governed by and interpreted in accordance with local laws of the city in which the listing is located.

• Payment. Acceptable payment methods are through the original booking channel or directly with The Host. If you wish to use a credit card, additional information may be requested in a future stage.

• Refunds. There will be no refunds for early departures, for breakdowns of air conditioner, heater, appliances, etc. All signatories to this agreement are jointly and severally responsible for the faithful performance of this lease. All payments made shall be applied to any outstanding balances of any kind including damages and /or any other charges due under this rental. All late charges, interest, NSF, or bank fees, and any monies due under this lease are hereby defined as, intended and considered to be additional rent.

RENTAL RULES
Throughout the Rental Period, the Guest shall, and shall ensure that the Rental Party and any Visitors to the Rental Unit shall:

1. Maintain the Rental Unit at all times in a good and tidy condition.
2. Not smoke inside the Rental Unit and shall dispose of any cigarette butts outside of the Rental Unit in a safe manner.
3. Not cause or create a nuisance or otherwise interfere with the quiet enjoyment of other occupants of the neighborhood in which the Rental Unit is located.
4. Not bring pets or other animals into the Rental Unit without the express advanced consent of The Host.
5. Not move or rearrange any furniture or appliances inside of the Rental Unit.
6. Comply with all Applicable Laws.
7. Leave the Rental Unit in the same condition of cleanliness in which they found it.

Violation of these terms and conditions or any other term and/or condition of the Agreement is grounds for notice to vacate the dwelling and to terminate this Agreement.

• Recourse. Guest acknowledges that, if all rental monies have been paid, the maximum recourse the Guest has against the Host or the Owners for any alleged breach of this Agreement is the amount of the rental paid to arising out of this Agreement.

• Entire Agreement. This Agreement constitutes the entire understanding between the parties, and rental of this property constitutes agreement to the Terms. This Agreement may only be amended in writing signed by both parties.
